This notice is to advise that on March 4, 2022, upon the entry of Executive Order 292, Governor Murphy took actions to continue in full force and effect Administrative Orders and waivers that were entered by the Division of Consumer Affairs prior to that date and which remained in effect as of that date. A full chart listing all current Administrative Orders and waivers is set forth below. The Orders and waivers in the chart will continue to be in full force and effect until the State of Emergency declared initially on March 9, 2020 is no longer in effect, or until the Division acts to revoke or modify any of the Administrative Orders or waivers, whichever occurs sooner.

NOTICE TO ALL GROUP 2 INDIVIDUALS HOLDING TEMPORARY EMERGENCY RECIPROCITY LICENSES (TERLS) OF PROGRAM EXTENSION

On January 12, 2022, Governor Murphy signed S4139/A6155 into law. The new law extends the expiration date for all currently issued and valid Group 2 temporary emergency reciprocity licenses (“TERL”s). Additionally, the law provides that qualified individuals may continue to apply for and obtain Group 2 TERLs through June 30, 2022 (Group 1 TERLs expired in 2021). All other terms and conditions applicable to practice by individuals holding TERLs continue in full force and effect.

All Group 2 TERLs are scheduled to expire on July 1, 2022. The Division continues to urge all health care professionals holding TERLs, who anticipate any need to continue to provide services pursuant to a New Jersey healthcare license, to obtain full licensure prior to the expiration of the TERL, in order to avoid any foreseeable interruptions of care that might be occasioned by the loss of continued licensure in New Jersey

NOTICE TO ALL GROUP 2 INDIVIDUALS HOLDING TEMPORARY EMERGENCY RECIPROCITY LICENSES (TERLS) OF PROGRAM EXTENSION

 

This notice is to advise that the Division of Consumer Affairs has determined that good cause exists to extend the expiration date of all temporary emergency reciprocity licenses (TERLs) issued to healthcare professionals in Group 2 professions (see list below) through January 11, 2022.  This extension is automatic and applies regardless of whether the TERL currently held had been scheduled to expire on September 30, 2021 (that is, for all individuals who did not file plenary license applications on or before July 31, 2021) OR to expire not later than December 31, 2021 (for all current TERL holders who had filed applications for plenary licensure on or before July 31, 2021).

Additionally, the Division is currently reopening the TERL program to all Group 2 health care professionals, and will accept new applications for TERL licenses from qualified out-of-state practitioners through January 11, 2022.  All new TERL licenses issued will expire on January 11, 2022, regardless of the date of issue.

The Division currently anticipates that this will be the final extension of expiration dates that will be offered for TERL holders.  Based on current law, the waivers and actions taken by the Division that enabled the TERL program to be created are set to expire on January 11, 2022.  The Division continues to urge all TERL holders who anticipate any need to continue to provide healthcare services to patients in New Jersey to apply, immediately, for a plenary license to avoid any possible interruption of your ability to continue to provide healthcare services to your patients.  Please note that should your application for a plenary license be rejected or not be approved for licensure by January 11, 2022, regardless of the reason, you must immediately cease providing healthcare services to your patients in New Jersey.

NOTICE TO ALL INDIVIDUALS HOLDING TEMPORARY EMERGENCY RECIPROCITY LICENSES (TERLs) OF PROGRAM DISCONTINUATION


Effective Friday, June 4, 2021, the Division will no longer accept any new applications for TERLs.

 

ALL TERLs ISSUED TO HEALTHCARE PROFESSIONALS IN GROUP 1 WILL EXPIRE ON JUNE 30, 2021

 

ALL TERLs ISSUED TO HEALTHCARE PROFESSIONALS IN GROUP 2 WILL EXPIRE ON SEPTEMBER 30, 2021

Background:  In March 2020, the Division of Consumer Affairs (the Division) announced and established a Temporary Emergency Reciprocity Licensure (TERL) program to give emergency licenses to health-care practitioners licensed in states outside of New Jersey.  Healthcare professionals who obtained TERLs are authorized to fully engage in the practice of their profession in New Jersey, both in person and through telehealth, without going through the New Jersey licensure process. These extraordinary actions were taken in order to address the unprecedented strain and stress which the COVID-19 outbreak placed on the entire health care delivery service in New Jersey. The emergency licenses issued under the TERL program and have always and explicitly been temporary.

As of Friday, June 4, the State’s Public Health Emergency has been terminated, and the Division has accordingly determined that it will wind down the TERL program. No new licenses will be issued, and existing licenses will be allowed to expire effective June 30, 2021 or September 30, 2021, dependent on the particular need for providers in specific healthcare professions. At present, the Division does not anticipate any further extensions of TERLs, except as described below for individuals who are in the process of obtaining a plenary license.

Notice of Discontinuation of TERL Program:

The Division will:

  •   no longer accept any new TERL applications as of June 4, 2021;

  •   allow all TERLs issued to healthcare professionals with Group 1 licenses to expire on June 30, 2021;

  •   allow all TERLs issued to healthcare professionals with Group 2 licenses to expire on September 30, 2021; and

  •   grant limited extensions only for those who are in the process of obtaining a plenary license.

Actions you need to take:  Review the lists below to determine whether you have a Group 1 or a Group 2 license.  Carefully review the information below that explains how the end of the TERL program affects your ability to continue to engage in any further practice in New Jersey.

 

Information For TERL Holders with Group 1 Licenses:

The Division stopped issuing new TERLs effective March 1, 2021 for most of these license types, and previously provided notice that all TERLs for all these license types would expire on June 30, 2021.

You are reminded that you have a professional obligation to ensure that you make appropriate arrangements for the transfer of care of all impacted patients prior to the expiration date.

As of July 1, 2021, Group 1 TERLs will cease to be valid.  You must, by July 1, 2021, cease and desist from engaging in any and all health care practice that would otherwise require a plenary (regular, full) New Jersey license.  Failure to do so would violate New Jersey law, and you could be subject to civil or criminal actions for unlicensed practice in New Jersey. You could also be liable for sanctions in your home state if you engage in unlicensed practice in New Jersey.

HOWEVER, if you currently hold a Group 1 TERL, you will receive a one-time extension of your TERL, ONLY IF you have filed an application for a plenary New Jersey license on or before June 4, 2021.

If you have filed an application for a plenary license by that date, you will receive a one-time extension of your TERL from June 30, 2021 until the earlier of: (1) the date on which the licensing board or committee either grants or denies your application for a New Jersey license; or (2) September 30, 2021.  To receive the extension, you must have filed the required application, have paid all required application and/or licensing fees, and be actively continuing the application process.  The Division anticipates that this extension will allow anyone presently holding a Group 1 TERL who has applied for a plenary New Jersey license adequate time to complete the application process.

 

 

Information for TERL Holders with Group 2 Licenses:

All previously issued Group 2 TERLs – which had been scheduled to expire on June 30, 2021 – will be automatically extended through September 30, 2021.   This extension is automatic; you do not need to take any action to receive it.   You are reminded that you have a professional obligation to ensure that you make appropriate arrangements for the transfer of care of all impacted patients prior to the expiration date.

As of October 1, 2021, Group 2 TERLs will cease to be valid.  Individuals holding such licenses must, on or prior to October 1, 2021, cease and desist from engaging in any and all health care practice that would otherwise require a plenary (regular, full) New Jersey license.  Failure to do so would violate New Jersey law, and you could be subject to civil or criminal actions for unlicensed practice in New Jersey. It could also subject you to discipline in your home state.

HOWEVER, if you currently hold a Group 2 TERL, you will receive a further one-time extension of your TERL, ONLY IF you file (or have filed) an application for a plenary (regular, full) New Jersey license on or before July 31, 2021. For information on how to apply for a plenary license, please review your relevant board’s website for links to the appropriate application.

If you file an application for a plenary license on or before July 31, you will receive a one-time extension of your TERL from September 30, 2021 until the earlier of: (1) the date on which the licensing board or committee either grants or denies your application for a New Jersey license; or (2) December 31, 2021.  To receive the extension, you must have filed the required application, have paid all required application and/or licensing fees, and be actively continuing the application process.  The Division anticipates that this extension will allow anyone presently holding a Group 2 TERL who has applied, or who files an application prior to July 31, 2021, for a plenary New Jersey license adequate time to complete the application process by the end of 2021.

PAUSE IN THE TEMPORARY EMERGENCY OUT-OF-STATE PROGRAM FOR CERTAIN CATEGORIES

This notice is to advise that, effective March 1, 2021, the Division is suspending new applications for the Temporary Emergency Reciprocity Program for all health care professions regulated by the following boards and committees: 

  • Acupuncture Examining Board 
  • Athletic Training Advisory Committee 
  • Audiology and Speech-Language Pathology Advisory Committee 
  • State Board of Dentistry 
  • Genetic Counseling Advisory Committee 
  • Hearing Aid Dispensers Examining Committee 
  • State Board of Examiners of Ophthalmic Dispensers and Ophthalmic Technicians 
  • State Board of Optometrists 
  • State Board of Polysomnography 

Effective March 1, 2021, no new applications for Temporary Emergency Reciprocity Licenses will be accepted from, and no new temporary reciprocity licenses will be issued to, any out-of-state individuals seeking to practice health care professions regulated by any of the above boards and committees.  All individuals holding previously granted temporary reciprocity licenses for license categories regulated by the above boards and committees (to include any licenses which may be granted before the close of business on February 28, 2021)  will remain valid through June 30, 2021, provided the Public Health Emergency remains in place.  

This notice does not impact the continuation of the Program for all other previously eligible licensee categories.  New applications will continue to be accepted and processed from eligible categories of health care practitioners; however, regardless of the date of issuance, all emergency reciprocity licenses will expire on June 30, 2021, provided the Public Health Emergency remains in place.   

All individuals holding emergency reciprocity licenses that will expire on June 30, 2021 are urged to carefully review the Notice the Division posted on January 26, 2021 addressing the need to apply for a plenary license for any temporary licensee who anticipates any need to provide health care services to New Jersey residents after June 30, 2021.  To apply for a plenary New Jersey license, visit https://www.njconsumeraffairs.gov/Pages/onlinelicenses.aspx.

As of  January 19, 2020 
IMPORTANT NOTICE TO ALL INDIVIDUALS HOLDING TEMPORARY EMERGENCY RECIPROCITY LICENSES REGARDING MODIFICATION OF TERMS OF PROGRAM: EXTENSION OF EXPIRATION DATE OF ALL LICENSES THROUGH JUNE 30, 2021

This notice is to advise you that the Division of Consumer Affairs is modifying the previously announced terms of the Temporary Emergency Reciprocity Licensure Program for out-of-state licensed health care practitioners. Specifically, all licenses that have previously been issued – all of which are currently scheduled to expire on February 28, 2021 -- will have their expiration date extended through June 30, 2021, provided that the Public Health Emergency remains in place. Any new licenses that may hereafter be issued will similarly be valid only through June 30, 2021, provided that the Public Health Emergency remains in place.  

If you presently hold a current temporary emergency reciprocity license, you do not need to make any written request, or take any other action, in order to obtain the extension of your license through June 30, 2021, as the extension will be automatically applied to all current licenses, provided that the Public Health Emergency remains in place.

The Division urges all health care providers presently holding temporary emergency reciprocity licenses, who anticipate any need to continue to provide health care services to New Jersey patients after June 30, 2021 (i.e., any services for which a New Jersey issued license would ordinarily be required), to immediately apply for a plenary New Jersey license. License applications can take significant time to process. Emergency reciprocity licenses will not become plenary licenses, or result in any modified application process for receiving a plenary license; you must apply for a plenary New Jersey License through the regular process to continue practicing in New Jersey after June 30, 2021. 

If you allow your temporary emergency reciprocity license to expire as of June 30, 2021, you will thereafter not be able to continue to provide any health care services for which a plenary New Jersey license would otherwise be required. You are reminded that, in such event, you have a professional obligation and responsibility to ensure that you make appropriate arrangements for the transfer of care of all impacted patients.
