ACUPUNCTURE EXAMINING BOARD I ROLL CALL PRESENT Henry McCann, Edith Lee, Barbara Montana, Roger Rossi, Mark Matzen ABSENT Shoshanna Katzman, Mimi Vassilev-Baker, Nita Raval, Karen Wei-Ru Lin ALSO PRESENT Renee P. Clark, Executive Director Tanya Gollett, Administrative Staff Megan Cordoma, DAG CALL TO ORDER The regular monthly meeting of the Acupuncture Examining Board was called to order at 124 Halsey Street at 9:30 a.m., all members having been notified of the time, date and, place and materials pertinent hereto having been provided. SUNSHINE LAW In compliance with Chapter 231 the Public Law of 1975, notice of this was sent to the Courier-Post and the Record. II. MINUTES A motion was made for the January 16, 2008 minutes to be tabled for next meeting. The motion carried by unanimous vote. III. CORRESPONDENCE 1. Catherine Dean asks that the board review her application and correspondence to see if she is qualified for licensure. The University of Massachusetts at Amherst sent the Acupuncture Examining Board a letter stating that they accepted Ms. Dean in to their masters degree program without a traditional stand-alone bachelor’s degree, based on her educational background. Consistent with the Board’s past decisions, the Board denied her application for licensure based on the fact that she did not have a traditional, stand-alone, baccalaureate degree. A motion was made by Roger Rossi and seconded by Barbara Montana. The motion was carried by a unanimous vote. 2. Lotus Institute of Integrative Medicine asks that their Continuing Education Units be approved for Acupuncturist’s in the State of New Jersey. After the information was reviewed, the Board determined that although it does accept NCCAOM-approved continuing education courses, the Board does not distribute course information to its licensee base. The Board directed Lotus Institute to contact professional acupuncture associations to distribute their materials. IV. Mr. Ed Raskin C.A. had questions for the Board. The answers from the Board were as follows: 1. Can a chiropractor hire an acupuncturist? Yes, because this is not addressed in our regulations. 2. Can a chiropractor bill for acupuncture using his tax ID? All billing must be properly coded and must Identify the individual who actually performed the service. 3. Can an acupuncturist perform the cold laser therapy? Yes, pursuant to N.J.A.C 13:35-9.9 of the regulations. V. REVIEW OF PHYSICIAN ACUPUNCTURE PROGRAM AND APPLICATIONS
1. Byung Yu The New Jersey State Acupuncture Examining Board has reviewed these applications, including the acupuncture training at the Academy of Pain Research/ Oakstone Medical Publishing/ St. Luke’s Hospital/UCI course information, at its February meeting. The Board has determined that this program does not satisfy the requirement of 150 clinical hours pursuant to the regulation N.J. A.C. 13:35-9.16 Training required of a physician or dentist. This regulation states that: The course of training shall be for a minimum of 300 hours, which shall include a clinical training program of at least 150 hours. The Board has determined these applicants do not meet our requirements for endorsement at this time. VI. GENERAL QUESTIONS FOR BOARD REVIEW The answers from the Board were as follows: 1. Can predated transcripts from the acupuncture schools be accepted to process applicants applications? The Board requires that applicants have all requirement’s in by the deadline. A motion was made by Barbara Montana and seconded by Mark Matzen. The motion was carried by a unanimous vote. 2. Can we accept transcripts from evaluation services as translated transcripts? Yes, we must have the original transcript in order to accept translated transcripts. The Board recommends that the Administrative office have NCCAOM send an updated list of approved foreign schools. A motion was made by Edith Lee and seconded by Barbara Montana. The motion was carried by a unanimous vote. Mark Matzen made a motion to proceed to Executive Session, seconded by Barbara Montana, to consider and review advertisement, consumer complaints and other information received pursuant to the Board’s investigative authority in order to determine whether violations of law, including Board regulations, have occurred. The results of these deliberations will be made known when, and if, the Board chooses to issue a Uniform Penalty Letter, the action will be taken in Public Session immediately after the Executive Session.
