V. LEGISLATIVE/REGULATORY

A. The Committee was advised that the draft regulations, addressing the sunset requirement for N.J.A.C. 13:34C-1 et seq. have been forwarded to the Office of the Attorney General for publication approval. B. The Committee was advised of a poll being conducted by the Office of the Director (Consumer Affairs) to ascertain whether the current requirement for continuing education is excessive. The Committee agreed that the 40 credits required for LCACDs and the 60 credits required for CADCs is not excessive but is one assurance that certificate holders and licensees maintain clinical competency.

VI. DAS MATTERS

A. The Committee reviewed a DAS notification sent to residential providers announcing an informal meeting and the initial opportunity for verbal comment on the DAS draft licensure residential regulations. The Committee noted the need for the revision of the language at N.J.A.C. 10: 161A-1.9(a)ii to clarify that a CADC is prohibited from making diagnoses. The Committee will continue to review the draft.

B. The Committee reviewed a copy of training that will be made available through the New Jersey Prevention Network. In response to an e-mailed request for approval clarification, the Committee referred to N.J.A.C. 13:34C-5 and the requirements for approval and approved providers.

VII. OLD BUSINESS

A. Center for Alcohol and Drug Studies

1. Rutgers SADS - Summer 2009

Upon review of the catalog for the Summer 2009 School of Alcohol and Drug Studies (July 19-24, 2009) the Committee discussed the problems associated with the publication of 2008 Committee approvals in the 2009 catalog. The 2009 catalog does not include the required disclosure statement (notification to students) as follows:

Approval by the Alcohol and Drug Counselor Committee does not ensure that course work will be accepted for initial certification or licensure in other jurisdictions or by the Certification Board. The Committee approval is for initial New Jersey state certification and licensure purposes only.

2. Class Rosters and Certificates of Completion -February 2, 2009 The following was reviewed as informational. - "Why Adolescents Programs Do/Do Not Work" - "Cognitive Behavioral Therapy for Substance Abuse/Dependence " - "Surviving Compassion Fatigue" - "Working with the Unconscious in Relapse Prevention"

VIII. NEW BUSINESS

Substance Abuse Evaluator; Title and Function Lynsey A. Johnson, Esq., Fox and Fox LLP 1:30 p.m. Representing the Probation Association of New Jersey (PANJ) On behalf of PANJ, Ms. Johnson attended the meeting to discuss the function of the Drug Court Substance Abuse Evaluator (SAE) to support the contention that the licensure requirements do not apply to the work performed by the SAE. Ms. Johnson was asked to submit any additional information to support the position.

XIV. FILED CONSENT ORDERS

1. William Gibson, CADC (voluntary surrender)

The January 26, 2009 filed Consent Order Of Voluntary Suspension of Certification to practice alcohol and drug counseling based upon receipt of information that he had relapsed in the use of alcohol and drugs. Pursuant to the Consent order Mr. Gibson surrendered his license and is required to engage in psychotherapy with a licensed healthcare professional pre-approved by the Committee. Mr. Gibson proposed Dennis Boyer, LCSW, LCADC for Committee review. The Committee will review whether Mr. Boyer has sufficient licensure experience to appropriately treat Mr. Gibson.

2. Ronald Teed, LCADC

In response to Mr. Teed’s request for an unrestricted license to practice alcohol and drug counseling, the Committee determined to schedule his appearance.

XV. NEXT MEETING

The next meeting of the Committee is scheduled for March 23, 2009 at 9:30 a.m. at 124 Halsey Street, Newark, New Jersey.
