LANDSCAPE ARCHITECT EXAMINATION AND EVALUATION COMMITTEE June 18, 2008 Public Session
I CALL TO ORDER The regularly scheduled meeting of the Committee was called to order at 10:10 am in the Union Conference Room on the third (3rd) floor at 124 Halsey Street, Newark, New Jersey.
OTHERS PRESENT: Michelle Albertson, Deputy Attorney General; James S. Hsu, Executive Director and Margaret Hinkley, Secretary to the Executive Director, Board of Architects. II OPEN PUBLIC MEETINGS ACT The statement required by Chapter 231, public laws of 1975, the "Open Public Meetings Act," was read and it was announced that notice of this meeting was prepared in the office of the Board of Architects and mailed to the Secretary of State, the Newark Star Ledger, the Trenton Times, the Camden Courier-Post, the Record and the Atlantic City Press. III APPROVAL OF MINUTES May 14, 2008 ACTION: Mr. Picatagi motioned to approve the minutes as presented. Mr. Kniesler seconded the motion. It passed unanimously. IV ANNOUNCEMENTS V OLD BUSINESS No business was discussed VI NEW BUSINESS A Legislation It is requested by the Division Director's office that the Board review the following bill and advise if a position is taken. 1 S-1805 - Permits removal of State board, commission or independent authority member for failure to attend three consecutive meetings thereof without good cause. ACTION: Mr. Picatagi motioned to support this legislation. Mr. Sardonia seconded the motion. It passed unanimously. 2 S-1815 - Requires legal action against certain licensed persons to be brought within two years. ACTION: Mr. Sardonia motioned to support this legislation and recommend that if Certified Landscape Architects is not included in the list of professions, they would like to be added C.2A:53A-26. Also clarify which "attorneys fees will not be awarded" does attorney refer to the plaintiff or defendant. Mr. Picatagi seconded the motion. It passed unanimously. B Information 1 Copy of an e-mail from CLARB regarding the May 2008 Member Board E-News is attached for Committee’s information. ACTION: Duly noted. 2 Copy of an e-mail from CLARB regarding the proposed changes to the Accreditation Standards for Landscape Architectural Degree Programs is attached for Committee’s information. ACTION: This email will be forwarded to the Committee members to check out the website and make comments. 3 Announcement from the Office of the Attorney General announcing David Szuchman is the new Director of the Division of Consumer Affairs is attached for the Committee’s information. ACTION: Duly noted. C Correspondence 1 Copy of a letter dated May 18, 2008 from Anthony Beliaeff, AS000381, advising that he has earned 15 of the 24 continuing education credits for the 2008/2010 renewal period and requesting a waiver for the remaining 9 continuing education credits due to illness is attached for the Committee’s review. ACTION: Mr. Sardonia recused himself in this matter. Mr. Picatagi motioned to grant Mr. Beliaeff the waiver for the remaining 9 continuing education credits for the 2008/2010 renewal period. Mr. Kniesler seconded the motion. It passed unanimously. 2 Copy of a letter dated June 13, 2008 from Shawn Heslin who has a BS in Environmental Planning & Design with the Industry Option from Rutgers and requests whether this meets the requirement for certification is attached for the Committee’s review. ACTION: Mr. Picatagi motioned to send a letter advising that in accordance with N.J.A.C. 13:27-8.4b provide the Committee with his certified transcript and a true and accurate course description for each of the landscape architecture courses for which the candidate is seeking credit toward certification. Also write to Jean Marie Hartman, Head of the Landscape Architecture Department at Rutgers University and request the curriculum for the BS in Environmental & Planning as well as the other options offered with the degree. Mr. Sardonia seconded the motion. It passed unanimously. VII APPLICATION REVIEW A. New Jersey Test The following individuals have completed their application for certification without examination and will be scheduled to take the New Jersey Test pending approval: Sidwell, Denise Trust, Dan ACTION: Mr. Kniesler motioned to approve the above individuals to take the NJ Test. Mr. Picatagi seconded the motion. It passed unanimously. B Examination The following individual submits a completed application including verification of passing the LARE, for the Committee to determine their eligibility to sit for the NJ Test. Ospina, Juan C. Yadlovski, Jason ACTION: Mr. Kniesler motioned to approve the above individuals to take the NJ Test. Mr. Picatagi seconded the motion. It passed unanimously. VIII PUBLIC COMMENTS Seeing no one present from the public, Ms. Young proceeded to the next item on the agenda. IX CONTINUING EDUCATION: A. The following courses have been submitted for the Committee to review and determine credit eligibility. COURSE/SEMINAR HOURS
1 Tree Establishment in urban and Difficult Sites: A Short Course
6 hrs ACTION: Mr. Kniesler motioned to approve the continuing education course for the number of hours as noted above. Mr. Picatagi seconded the motion. It passed unanimously. X CLOSED CASES 1 ITEM NO. 57901 - VECCHIONE, William - Unlicensed / B&G Landscape Architects LLC – The Committee reviewed a complaint against B&G Landscape Architects LLC concerning advertising landscape architecture. Subsequent to reviewing the documentation provided indicating the website has been corrected, the Committee unanimously voted to close out this matter. CASE CLOSED. 2 ITEM NO. 57906 - SPONZILLI, Dan - Unlicensed / Sponzilli Landscape Group – The Committee reviewed a complaint against B&G Landscape Architects LLC concerning advertising landscape architecture. Subsequent to reviewing the documentation provided indicating the website has been corrected, the Committee unanimously voted to close out this matter. CASE CLOSED. 3 ITEM NO. 57883 - KAYE, Robert - Unlicensed / Nature View Landscaping, Inc – The Committee reviewed a complaint against B&G Landscape Architects LLC concerning advertising landscape architecture. Subsequent to reviewing the documentation provided indicating the website has been corrected, the Committee unanimously voted to close out this matter. CASE CLOSED. 4 ITEM NO. 57885 - CHOMUK, Dan - Unlicensed / Nature View Landscaping, Inc – The Committee reviewed a complaint against B&G Landscape Architects LLC concerning advertising landscape architecture. Subsequent to reviewing the documentation provided indicating the website has been corrected, the Committee unanimously voted to close out this matter. CASE CLOSED. X EXECUTIVE SESSION At 11:05am, Mr. Kniesler motioned to go into executive session for the purposes of reviewing the minutes and disciplinary matter on the agenda. Mr. Sardonia seconded the motion.
