NEW JERSEY STATE BOARD OF DENTISTRY
PUBLIC SESSION MINUTES BOARD OFFICE NEWARK, NEW JERSEY SEPTEMBER 17, 2008 ATTENDANCE: The following members were in attendance: Emil Cappetta, DDS; Patricia Delaney, RDH, Ed.M; Peter DeSciscio, DMD; Herbert Dolinsky, DDS; Maxine Feinberg, DDS; Karen Golding; Alexander Hall, DMD; Beverly Kupiec, RN, Ph.D.; Sally-Jo Placa, DMD; John Ricciani, DMD; Arnold Rosenheck, DMD OTHER ATTENDEES: Deputy Attorneys General Nancy Miller and Joseph Donofrio; Executive Director, Jonathan Eisenmenger; Michael Dominach, Paralegal; Cecilia Moreira, Senior Management Assistant ABSENT AND/OR EXCUSED: Ms. Belinda Caraballo NOTE: The Public Session Agenda commenced at 9:30 A.M. I. APPROVAL OF MINUTES: September 3, 2008 - Approved as amended. II. NOTE: The Board will start the November 5, 2008 meeting at 10:00 A.M. The complaint review committees will not meet at 8:00 A.M. as previously scheduled. III. COMMITTEE REPORTS: 1. Credentials: Dental: - Dr. Robert Fredrickson - Application for a New Jersey dental license. Dr. Fredrickson meets all requirements for licensure. The committee recommended approval. - Dr. Eric Blamires - Application for a residency permit. Dr. Blamires meets all requirements for the permit. The committee recommended approval. - Dr. Jin Hwang - Application for a New Jersey dental license. Dr. Hwang meets all requirements for licensure. The committee recommended approval. Dental Auxiliaries: - Jo-Ann White Townsend - Application for a dental hygiene license. Mr. Townsend meets all requirements for licensure. The committee recommended approval. The Board in a motion by Dr. Kupiec, seconded by Ms. Delaney, approved the committee recommendations. IV. MEETING DATES FOR BOARD OF DENTISTRY MEETINGS FOR 2009: The Board determined to place the list of meeting dates on the October 1, 2008 agenda for approval. V. APPLICATION FOR REINSTATEMENT OF LICENSE: 1. Dr. Daniel Ripps - Application for reinstatement of his New Jersey dental license. The Board moved this matter to Executive Session. The Board determined that an appearance be scheduled. VI. DELIBERATION OF CASE FOLLOWING APPEARANCE OF AUGUST 6, 2008: 1. Dr. Gerald P. Hirsch - The Board moved this matter to Executive Session for deliberation. After discussing this matter the Board in a motion by Dr. Dolinsky, seconded by Dr. Rosenheck, determined the following:
- Nine year suspension retroactive to December 1999. He will be reinstated effective
January 2009. Dr. Placa and Ms. Delaney voted against the motion. VII. PROVISIONAL ORDERS OF DISCIPLINE TO BE FINALIZED: 1. Dr. Lloyd Calder - The Board discussed the Provisional Order of Discipline filed by the Board and Dr. Calder’s response. The Board moved this matter to Executive Session for deliberation. The Board in a motion by Dr. Feinberg, seconded by Dr. Rosenheck, determined that the POD be finalized as written. 2. Dr. Hee Joon Kwak - The Board discussed the Provisional Order of Discipline filed by the Board. Dr. Kwak did not respond to the POD. The Board moved this matter to Executive Session for deliberation. The Board in a motion by Dr. Feinberg, seconded by Dr. Rosenheck, determined that the POD be finalized as written. 3. Dr. Gerald J. Whiteman - The Board discussed the Provisional Order of Discipline filed by the Board and Dr. Whiteman’s response. The Board moved this matter to Executive Session for deliberation. The Board in a motion by Dr. Feinberg, seconded by Dr. Rosenheck, determined that the POD be finalized as written. 4. Dr. Gary Reba - The Board discussed the Provisional Order of Discipline filed by the Board and Dr. Reba’s response. The Board moved this matter to Executive Session for deliberation. The Board in a motion by Dr. Feinberg, seconded by Dr. Rosenheck, determined that the POD be finalized as written. VIII. OTHER MATTERS: 1. The Board reviewed an inquiry from Taiba Solaiman, RDA, questioning whether it is within the scope of a dental license to fabricate the appliance used for treatment of obstructive sleep apnea. The Board determined that this is within the scope of the practice of a dentistry. 2. The Board reviewed an inquiry from Mrs. Chedva Werblowsky from Center for Health Education questioning whether a dental hygienist needs to be under direct supervision or merely general supervision when working at the center. The Board determined that additional information be obtained with regard to the layout of the facility and the location(s) in the facility where a dentist is practicing. IX. APPEARANCES: 1. 2:00 P.M. - Fern Ficarra, Dental Hygienist - Appearance concerning information disclosed on her application for reinstatement of her dental hygiene license.
