The Board Minutes of April 2, 2008, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of June 4, 2008, or soon thereafter as it may be considered. All requirements of the "Open Public Meetings Act" have been complied with according to N.J.S.A. 10:4-6.

The notice of the meeting has been mailed to the Newark Star Ledger, Camden Courier Post, and the Trenton Times, and also notice has been posted on the Bulletin Board at the office of the Secretary of State, Trenton, New Jersey.

Meeting of April 2, 2008, was called to order at 9:00 A.M.
The following members were present:

Marian Fiore, Sr. Management Assistant, was present from 9:00 A.M. until the close of the meeting.

Kathleen Moran, Administrative Assistant, III, was present from 9:00 A.M. until the close of the meeting.

Ginger R. Provost, Deputy Attorney General, Division of Law, was present from 9:00 A.M. until the close of the meeting.

Also in attendance was James Bibbo, Central Jersey Electrical League.

The Board saluted the Flag.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve the Open Session Minutes of the 819th Business Meeting held March 5, 2008.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve (32) Initial Licenses effective April 2, 2008 to March 31, 2009.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve (27) Initial Business Permits effective April 2, 2008 to March 31, 2009.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve (10) Changes In Business Permits effective April 2, 2008 to March 31, 2009.

The Board requested that a letter be sent to Facility Solutions Group, Inc. requesting that they remove the company name "Design Electric" from the bottom of their letterhead as this company is no longer licensed to engage in the business of electrical contracting in the State of New Jersey.

Check in the amount of $50.00 received from Jay A. Alexander, Unlicensed, as the second installment of a civil penalty in the amount of $1,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq. Payments started August 27, 2007 and the balance due is $1,250.00.

The Board accepted the payment.

Check in the amount of $4,000.00 received from Luis Rodriguez, Unlicensed, as the first and final installment of a civil penalty in the amount of $4,000.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq.

The Board accepted the payment.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Victor V. Timpanaro.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that fifteen (15) new courses, and instructors, are approved as submitted.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Colin Hylton.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Mitchell R. Malec, and unanimously passed, that a letter be sent to Mr. Hylton advising him that his request is denied. The Board requests that Mr. Hylton complete a Continuing Education application listing each course to be approved. Additionally, Mr. Hylton is to provide a detailed outline for each course listed on the Continuing Education application.

The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from Christina Bailey, American Trainco, Inc.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve Robert J. Clukey to teach a previously approved course.

Letter dated March 18, 2008, received from Joseph Delasey, License #8533, t/a Delasey & Son Electrical Contractors, requesting a waiver of the Continuing Education Courses for the 2009 to 2012 renewal period.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that a letter be sent to Mr. Delasey advising him that the Board will consider his request for a waiver pending an update on his medical condition in six months.

Letter dated March 12, 2008, received from Harry Rosenzweig, License #4082, t/a Harry’s Electrical Service, requesting a waiver of the Continuing Education Courses for the 2009 to 2012 renewal period.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that a letter be sent to Mr. Rosenzweig advising him that his request for a waiver is being held in abeyance pending receipt of medical documentation giving the dates he became ill and how long he will be under a doctor’s care.

Letter dated March 20, 2008, received from Michelle Thomas, Licensing Manager, Pinnacle Security, requesting clarification of the licensing requirements for burglar and fire alarm installers and an electrical contractor’s license in order for the company to sell, install and monitor security systems in the State of New Jersey.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, that a letter be sent to Ms. Thomas advising her that there are no licensing requirements for salesmen or technicians working for her company; the technicians would be supervised by the licensed electrical contractor who holds the business permit and will have full responsibility for all work conducted by the technicians being supervised. Ms. Thomas is to also be advised that a license and business permit are required in order to perform any and all electrical work in the State of New Jersey with the exception of Exempt Work or Construction pursuant to N.J.S.A. 45:5A-18. In order to perform burglar alarm or fire alarm installation in the State of New Jersey, without having a license or business permit issued by the Board, a burglar or fire alarm license is required. Ms. Thomas is to be sent a copy of the licensing requirements for electrical contractors and burglar and fire alarm contractors. Ms. Thomas will be further advised that the laws concerning inspections are under the jurisdiction of the Department of Community Affairs.

A signed acknowledgment was received from Devin Lapenta, License #15333, t/a Arrow Electric South, acknowledging the formal reprimand against him in violation of N.J.S.A. 56:8-2 et seq. and N.J.A.C. 13:31-3.2.

The Board accepted the signed acknowledgment.

A signed cease and desist agreement was received from Paulo Nascimento, Hillsborough, New Jersey, agreeing to include the language in his advertisement that all electrical work is "performed by licensed electrical contractors". A signed cease and desist agreement was received from Louis Rodriguez, Clifton, New Jersey.

The Board accepted the signed acknowledgment.

Mr. McCullough stated that in September 2003 the Bureau of Fire Safety issued certifications to Fire Alarm Contractors. The Bureau of Fire Safety stipulated that fire alarm contractors and electrical contractors did not need the certification issued by the Department of Community Affairs as long as those licenses were issued before March 2004.

Mrs. Cook stated that a licensed electrical contractor or licensed fire alarm contractor would need this certification if their license was issued after March 2004.

The Board reviewed applications for the written examination to be administered by Thomson Prometric. Thirty (30) applications were approved.

Motion made by Mr. Robert A. McCullough and seconded by Mr. Constantinos Papademas, and unanimously passed, that the Board go into Executive Closed Session to consider and to review consumer complaints, investigative reports and other information received pursuant to the Board’s investigative authority in order to determine whether violations of the law, including Board regulations have occurred. The results of the deliberations will be made known when and if the Board determines to initiate disciplinary action or other law enforcement action.
