MINUTES OF JANUARY 20, 2009
PUBLIC SESSION

The notice of this meeting was prepared in the Office of the Board and mailed to the Secretary of State, the Star Ledger, the Trenton Times and the Courier Post.

CALL TO ORDER

The meeting of the Fire Alarm, Burglar Alarm and Locksmith Advisory Committee was called to order by Chairman Robert Shoremount at 10:15 a.m. in the Essex Room, Seventh Floor, 124 Halsey Street, Newark, New Jersey. All parties were duly notified of the date, time and location of this meeting and pertinent material was provided to meeting participants.

Attendees recited the Pledge of Allegiance prior to the roll call of members.

Committee members Edward Bagniewski, Robert Boyer, Richard Rible and Jon Sprague were unable to attend the meeting.

George DeLuca, Administrative Analyst, was unable to attend the meeting.

ANNOUNCEMENTS

Due to Mr. DeLuca’s absence, Sally Barletta read the meeting announcements.

Advisory Committee staff has been coordinating efforts with Deputy Director Larry DeMarzo, and Francine Widrich, Management Improvement Specialist to identify and resolve operational, licensing, and database issues. The effort is ongoing.

The Division MIS unit has posted licensed businesses on the Advisory Committee’s web site through the "Licensee Search". The project was time consuming and complex since different databases required merging and conversion to "web site friendly" software.

Information has been forwarded to Francine Widrich with regard to the Committee’s request that the Division of Consumer Affairs provide accurate and updated information on licensing and scopes of practice to the Department of Labor for use on its Business web site.

Staff has prepared nine (9) individual license applications and five(5) business license applications for the Committee’s review.

The Advisory Committee requested that all code officials be sent correspondence advising them of the updated Department of Labor’s Business website.

APPROVAL OF MINUTES OF DECEMBER 16, 2008

Upon review of the minutes of the December 16, 2008 Public Session, the Advisory Committee recommended to amend the following:

page six (6), paragraph two (2)

Remove "Respectfully Submitted, Robert Shoremount, Chairman and replace it with "Amended and approved by Advisory Committee Chairman, Robert Shoremount."

Subsequent to the discussion, motion was by Charles Okun, seconded by Arthur Fucetola and unanimously passed to approve the amended Public Session minutes of the December 16, 2008 meeting.

CHAIRMAN’S REPORT

Chairman Shoremount requested that Nomination of Officers be placed on the Public Session agenda for the February 17, 2009 meeting.

The instructors for the continuing education programs were also approved by the Subcommittee.

Motion was made by Charles Okun, seconded by Keith Eaves and unanimously passed to approve the recommendations made by the Continuing Education Subcommittee.

REVIEW OF PROPOSED LEGISLATION, ASSEMBLY BILL A-3558

The Bill, Introduced On December 15, 2008, Provides That Only Licensed Locksmiths May Program Motor Vehicle Transponder Keys

-Request For Comments (See Enclosed "Draft" Memorandum)

The Advisory Committee reviewed and discussed comments previously submitted with regard to Assembly Bill A-3558. The Bill, introduced on December 15, 2008, provides that only licensed locksmiths may program motor vehicle transponder keys.

Motion was made by Charles Okun, seconded by William Hartung and unanimously passed to accept the "Draft" memorandum as presented.

CORRESPONDENCE

NJBFAA ANNUAL SYMPOSIUM

- Correspondence From Rich Trevelise, Vice President Elect, With Regard To Anticipated Attendance, Classroom Occupancy, And Format For Presentation Of Continuing Education Programs

The Advisory Committee reviewed and discussed correspondence received from Rich Trevelise, Vice President Elect, with regard to anticipated attendance, classroom occupancy, and format for the NJBFAA Annual Symposium of Continuing Education programs. Motion was made by Keith Eaves, seconded by William Hartung and unanimously passed to grant a waiver of Continuing Education requirement that classroom size not exceed 75 attendees due to the anticipated volume of licensees who may attend continuing education seminars offered at the symposium.

PUBLIC COMMENTS

Rich Trevelise, a fire alarm and burglar alarm licensee and a member of New Jersey Burglar and Fire Alarm Association, invited the Advisory Committee to attend the New Jersey Burglar & Fire Alarm Association Annual Symposium held on January 29 & 30, 2009.

Mr. Trevelise questioned whether the Continuing Education Courses he submitted were approved by the Advisory Committee. The Advisory Committee informed Mr. Trevelise that he must submit courses to the Advisory Committee subcommittee for approval.

Mr. Trevelise also inquired about the process for appointing the new Executive Director. Chairman Shoremount informed Mr. Trevelise that the process for appointing the new Executive Director is handled internally within the Division of Consumer Affairs.

Rich Trevelise inquired about the list of Continuing Education Sponsors. Chairman Shoremount informed Mr. Trevelise that a list of Continuing Education Sponsors is listed on the website.

Mr. Trevelise also inquired if the alarm and locksmithing examinations are going to be updated. Chairman Shoremount informed Mr. Trevelise that the alarm and locksmithing examinations have been modified to reflect the new code requirements as new codes are approved.

Anthony De Santis asked whether New Jersey Licensing Board will accept a New York License to perform alarm and locksmithing services in New Jersey. Chairman Shoremount informed Mr. De Santis that a New Jersey License is require to perform alarm and locksmithing services in State of New Jersey.

Motion was made by Arthur Fucetola, seconded by Charles Okun and unanimously passed to adjourn the Public Session at 11:30 a.m. and proceed into Executive Session.

Motion was made by Keith Eaves, seconded by William Hartung and unanimously passed to adjourn the Executive Session at 1:30 p.m. and proceed into Public Session.

DEPUTY ATTORNEY GENERAL REPORT

- IMO Gilad Gill, Final Order Of Discipline

The Advisory Committee reviewed and discussed a Final Order of Discipline for Gilad Gill. Motion was made by Arthur Fucetola, seconded by Charles Okun and unanimously passed to issued Final Order of Discipline (FOD) to Gilad Gill with regard to his failure to respond to the Provisional Order of Denial (POD) within 30 days.

The Advisory Committee reviewed and discussed the Final Order, Denial of Licensure for Dagoberto Perez. Motion was made by William Hartung seconded by Arthur Fucetola and unanimously passed to issued Final Order, of Denial of Licensure (FOD) to Dagoberto Perez with regard to his failure to respond to the Provisional Order of Denial (POD) within 30 days.

REVIEW OF CRIMINAL HISTORY "FLAGGING"

- Thomas J. Blasczak, Licensee

The Advisory Committee reviewed and discussed a criminal history summary recently provided to the Advisory Committee for Thomas J. Blasczak, a licensee. Upon discussion, it was determined that correspondence be sent to Mr. Blasczak issuing a Summary Order of Suspension, pursuant to N.J.S.A. 45:1-7.1 for failure to renew his burglar alarm and fire alarm licenses.

The Advisory Committee reviewed the applications of alarm and locksmith applicants seeking alarm and locksmith licenses at this meeting.

ADJOURNMENT

Having no further business, motion was made by Arthur Fucetola, seconded by Charles Okun and unanimously passed to adjourn the Public Session at 2:30 p.m. The minutes reflect actions and decisions taken by the Advisory Committee at this meeting.
