FIRE ALARM BURGLAR ALARM AND LOCKSMITH
ADVISORY COMMITTEE MINUTES OF MARCH 17, 2009 PUBLIC SESSION The notice of this meeting was prepared in the Office of the Board and mailed to the Secretary of State, the Star Ledger, the Trenton Times and the Courier Post. CALL TO ORDER The meeting of the Fire Alarm, Burglar Alarm and Locksmith Advisory Committee was called to order by Chairman Robert Shoremount at 9:45 a.m. in the Essex Room, Seventh Floor, 124 Halsey Street, Newark, New Jersey. All parties were duly notified of the date, time and location of this meeting and pertinent material was provided to meeting participants. Attendees recited the Pledge of Allegiance prior to the roll call of members. ROLL CALL Committee Members Present:

George DeLuca, Administrative Analyst Committee members William Hartung and Richard Rible was unable to attend the meeting. ANNOUNCEMENTS Correspondence will be sent to licensees whose businesses have not been licensed or have not applied for a business license. The correspondence will be a follow up to the original correspondence sent in November 2007. Disciplinary Actions taken by the Advisory Committee during the January and February meetings are stated in the Public Session minutes. To date, the Committee has licensed 400 businesses. A breakdown of business categories is not available at this time. Additionally, wall certificates for 142 licensed businesses are being printed, 28 business license applications are being processed by staff, and six (6) business license applications have been prepared by staff for review by the Advisory Committee at this meeting. Staff has prepared 13 individual license applications for review by the Advisory Committee at this meeting. APPROVAL OF MINUTES OF FEBRUARY 17, 2009 Upon review of the minutes of the February 17, 2009 Public Session, the Advisory Committee determined to amend the following: page two (2), paragraph two (2) and three (3) NJBFAA ANNUAL SYMPOSIUM - Correspondence From Rich Trevelise, Vice President Elect, With Regard To Anticipated Attendance, Classroom Occupancy, And Format For Presentation Of Continuing Education Programs The Advisory Committee reviewed and discussed correspondence received from Rich Trevelise, Vice President Elect, with regard to anticipated attendance, classroom occupancy, and format for the NJBFAA Annual Symposium of Continuing Education programs. Motion was made by Keith Eaves, seconded by William Hartung and unanimously passed to grant a waiver of Continuing Education requirements due to the amount of licensees needing to take the Continuing Education course and with the stipulation that any attendee who has questions can submit them in writing to the Continuing Education Instructor. Also, the Advisory Committee requested that all safety requirements be followed. page three (3), paragraphs one (1), two (2), three (3), four (4) and five (5) were amended as follows: Remove "Mr. Trevelise questioned whether the Continuing Education Courses he submitted were approved by the Advisory Committee. The Advisory Committee informed Mr. Trevelise that he must submit courses to the Advisory Committee subcommittee for approval." from the Public Session minutes for January 20, 2009 meeting. Subsequent to the discussion, motion was by Edward Bagniewski, seconded by Charles Okun and unanimously passed to approve the amended Public Session minutes of the February 17, 2009 meeting. CHAIRMAN’S REPORT Chairman Shoremount informed the Advisory Committee that Robert Boyer, Vice Chairman, George De Luca, Administrative Analyst, and he appeared before the Board of Electrical Contractors on March 4, 2009 with regard to the Township of Hamilton (Mercer County) denying a fire and burglar alarm permit unless a licensed electrical contractor obtains the permit. The Township indicates that a alarm contractor cannot install an earth ground on the burglar alarm panel without an electrical contractor’s license. The Advisory Committee was informed that the Board of Electrical Contractor’s reviewed proposed correspondence to be sent to the Township of Hamilton advising that fire alarm, burglar alarm and locksmiths are authorized to perform all work necessary to affect the installation of work within their respective disciplines up to and including connection to branch circuit wiring. Licensees are allowed to install, service, repair, or alter these systems. Chairman Shoremount also suggested that a letter be sent to the Township of Hamilton advising them that the installation of an equipment ground or bonding jumper is included in the scope of practice of a burglar alarm, fire alarm and locksmith installer as long as it is performed according to the National Electrical Code. Chairman - Robert Shoremount Motion was made by Edward Bagniewski, seconded by Charles Okun and unanimously passed to close nominations for the Office of Chairman. Following the closing of nominations, motion was made by Edward Bagniewski, seconded by Keith Eaves and unanimously passed to affirm the election of Robert Shoremount for the position of Chairman. Motion was made by Charles Okun, seconded by Keith Eaves and unanimously passed to close nominations for the Office of Vice Chairman. Following the closing of nominations, motion was made by Charles Okun, seconded by Keith Eaves and unanimously passed to affirm the election of Robert Boyer for the position of Vice Chairman. PUBLIC DISCIPLINARY ACTIONS REPORTED BY THE ADVISORY COMMITTEE - IMO Gilad Y. Gill, Licensee Final Order Of Discipline, Revocation Of Locksmith License The Advisory Committee reviewed and discussed the Final Order of Discipline (FOD), Revocation of Locksmith License for Gilad Gill with regard to his failure to respond to the Provisional Order of Denial (POD) within 30 days. - IMO Dagoberto Perez, Applicant Final Order of Discipline, Denial Of Burglar Alarm And Fire Alarm Licensure The Advisory Committee reviewed and discussed the Final Order of Discipline (FOD), Denial of Burglar and Fire Alarm Licensure for Dagoberto Perez with regard to his failure to respond to the Provisional Order of Denial (POD) within 30 days. - IMO Stanley T. Julius, Applicant Applicants Abandoned, Burglar Alarm And Fire Alarm Licensure Mr. Julius failed to provide written response within a 30-day period to the Advisory Committee with regard to additional information required for his application. The Advisory Committee requested correspondence be sent to Mr. Julius advising him that he must cease and desist from performing burglar alarm and fire alarm services until a license is obtained to do so and assessed a fine in the amount of $2,500.00. In the event Mr. Julius should request a future application for licensure, he will be required to comply with N.J.A.C. 13:31A-2.1. - IMO Arose, Inc., Unlicensed Practice Agreement To Cease And Desist, Agreement To Settlement Offer, Payment Of Fine The Advisory Committee reviewed and discussed correspondence received from Arose, Inc. with regard to a signed acknowledgment to cease and desist and a payment in the amount of $2,500.00. Motion was made by Edward Bagniewski, seconded by Keith Eaves and unanimously passed to adjourn the Executive Session at 2:00 p.m. and proceed into Public Session for the purpose of reporting the actions of the Advisory Committee. REVIEW OF CRIMINAL HISTORY The Advisory Committee reviewed and discussed a criminal history summary dated February 17, 2009 for one (1) applicant. Upon discussion, one (1) applicant has been approved for examination. REVIEW OF CRIMINAL HISTORY "FLAGGING" REVIEW OF APPLICATIONS FOR ALARM AND LOCKSMITH LICENSES The Advisory Committee reviewed the applications of alarm and locksmith applicants seeking alarm and locksmith licenses at this meeting. REVIEW OF APPLICATIONS FOR ALARM AND LOCKSMITH BUSINESS LICENSES The Advisory Committee reviewed the applications of alarm and locksmith businesses seeking business licenses at this meeting. ADJOURNMENT Having no further business, motion was made by Edward Bagniewski, seconded by Keith Eaves and unanimously passed to adjourn the Public Session at 2:30 p.m. The minutes reflect actions and decisions taken by the Advisory Committee at this meeting.
