Legalized Games of Chance Control Commission
Public Session Minutes January 14, 2009 The Legalized Games of Chance Control Commission met on January 14, 2009, at the Office of the Division of Consumer of Affairs, located at 124 Halsey Street, 7th Floor Essex Room, Newark New Jersey. Present for the meeting were Commissioners Marilou Halvorsen, Chairperson, Edward Barrett and Christine Vanek (via teleconference). Timothy E Ryan was not present. Assistant Counsel, Authorities, unit Office of the Governor, Joseph Neal, Deputy Attorney General Nancy Miller, LGCCC Supervisor to the Investigative Unit Scott Jenkins, Acting Investigative Supervisor William Carter, Investigators Martin Silva , Joseph Chessere, Christine Donahue and supporting staff Farah Rodriguez, Danyelle Williamson, Ava Paterman and Mari Latty were also present. The meeting was opened at 11:00 a.m. by Commissioner Marilou Halvorsen pursuant to provisions of the Open Public Meetings Act. N.J.S.A. 10:4-6 et seq. Adequate notice of the Legalized Games Public meeting was provided by mailing on January 7, 2009. A list of all regularly scheduled Commission meetings to be held during 2009 was provided to the Office of the Secretary of State, Star Ledger, Trenton Times, the Director of the Division of Consumer Affairs, and posted in the State Building at 124 Halsey Street, Newark, New Jersey, as well as being posted on LGCCC website: www.state.nj.gov/oag/ca/lgccc.htm. 1. Reading and Approval of the Agenda The Commission reviewed and approved the amended agenda. MOTION: Barrett SECOND: Vanek APPROVED: Unanimous 2. Minutes of the Public Session meeting October 08, 2008 The Commission reviewed and approved the amended minutes. MOTION: Barrett SECOND: Vanek APPROVED: Unanimous 3. Public Comment Edward McGlynn, Esq. asked to be heard when Commission discussed regulatory initiatives. At that time he stated representatives of the Amusement Association would like to meet with staff to address issues related to proposed amendments. 4. Statistics report and comparison figures from LGCCC to DCA for the month’s of September, October, and November 2008 MOTION: Vanek SECOND: Barrett APPROVED: Unanimous 5. List of organizations approved or denied requests for registration for the months of October, November and December 2008 The Commission approved the submitted list except for Fredon Volunteer Fire Company list for registration applications for October, November and December 2008 Commissioner Vanek, recused herself in the application of Fredon Volunteer Fire Company (October 08) MOTION: Barrett SECOND: Vanek APPROVED: Unanimous Motion to approve Fredon Volunteer Fire Company MOTION: Barrett SECOND: Halvorsen (Vanek recused)APPROVED: Unanimous 6. Recommended approval for the approved and denied list of Casino Operators; Casino Operators Pending Additional Correspondence; Manufacturers, Distributors, and Providers, Compensated Workers and Games Submissions for the Month of October, November, and December 2008 The Commission approved the recommendations of staff regarding of Casino Operators, Manufacturers, Games Submissions, Distributors, and Providers and Compensated Workers for the months of October, November, and December 2008. MOTION: Vanek SECOND: Barrett APPROVED: Unanimous 7) Proposed Regulations A. Bingo prize limitations and prohibitions on members in charge buying raffle tickets - N.J.A.C. 13:47-7.2, 7.11 and 8.1 MOTION: Barrett SECOND: Vanek APPROVED: Voting yes: Commissioner Barrett and Vanek. Abstaining Commissioner Halvorsen. B. Texas Hold'em, Three Card Poker and electronic game software - N.J.A.C. 13:47-5A.1, 20.2, 20.4, 20.40 and 20.41 To propose Texas Hold’em and Three Card Poker as a new game. MOTION: Barrett SECOND: Vanek APPROVED: Unanimous Motion to table rule related to electronic game software MOTION: Barrett SECOND: Vanek APPROVED: Unanimous C. Amusement games amendments - N.J.A.C. 13:3-3.5, 3.18, 4.2, 4.4 and 7.10 The Commission after hearing comments, determined to table this matter and requested staff meet with members of the New Jersey Amusement Association. 13:3-4.3 Commissioner Halvorsen opposed asking consumers for personal information. Alcohol as prizes - N.J.A.C. 13:47-6.19 MOTION: Barrett SECOND: Vanek APPROVED: Unanimous 8) Notice of Adoption: Readoption with Amendments N.J.A.C 13:3 FYI 9) Regulatory Committee recommendation for amusement games proposed amendments, non-draw raffles, bingo prizes and raffles runner proposed amendments; notification for electronic games and Texas Hold’em. The Commission will grant a credit of $100.00 towards a future fees; letter will be sent informing the organization of the Commission’s decision MOTION: Barrett SECOND: Vanek APPROVED: Unanimous 12) Old Business None 13) New Business Commissioner Barrett suggested that the Commission’s website have information regarding available outreach and training services. Scott Jenkins and Kimberly Rolle Samareill, Executive Director of New Jersey Amusement Association, will work together to set up a training program for the amusement games industry. Items moved from executive session F-1 2008 Report Charity Gaming (National Association of Fundraising Ticket Manufacture’s) Scott Jenkins informed David Szuchman, Director of DCA, and the Commission that New Jersey Legalized Games of Chance Control Commission rank 5th in the nation in number of to registered charities.
