The agency proposal follows:

Summary

The Division of Consumer Affairs (Division) reproposes a new rule, proposes amendments to an existing rule and proposes new disclosure statements as Appendices to N.J.A.C. 13:45A-22 in order to assist consumers in determining whether foods represented to be halal are prepared and/or maintained consistent with their expectations and understanding of the laws and customs of the Islamic religion. This proposal serves to implement the provisions of P.L. 2000, c.60 N.J.S.A. 56:8-98 et seq.), the "Halal Food Consumer Protection Act" and amends the halal rules that are adopted elsewhere in this issue of the Register, proposed at 35 N.J.R. 3754(a).

Reproposed new rule N.J.A.C. 13:45A-22.3 requires dealers who sell food as halal to complete and post in a location on its premises readily visible to customers a halal disclosure statement which will be provided to the dealer by the Division. The disclosure statements are included in this proposal as Appendices A through D. This new rule replaces the version of N.J.A.C. 13:45A-22.3 that was proposed by the Division on August 18, 2003 at 35 N.J.R. 3757(a) and was not adopted.

The reproposed new rule requires dealers of halal food to request the halal disclosure form and halal disclosure statement applicable to its business from the Division. The statements on the halal disclosure forms are identical to those contained on the halal disclosure statements included in the appendices. The dealer is required to complete and return the halal disclosure form to the Division within 14 calendar days of receipt. The dealer is required to complete and post the halal disclosure statement that it receives from the Division. The reproposed new rule would required a dealer's sales practices to conform to the disclosures contained in the posted disclosure statement and the disclosure form filed with the Division. Dealers that are slaughterhouses selling cattle, goats, sheep, and lambs represented as halal are to post the halal disclosure statement found in Subchapter 22 as Appendix A, which is incorporated into the rule by reference. Dealers that are slaughterhouses selling poultry represented as halal are to post the halal disclosure statement found in Subchapter 22 as Appendix B, which is incorporated into the rule by reference. Dealers that are retail establishments selling food represented as halal are to post the halal disclosure statement found in Subchapter 22 as Appendix C, which is incorporated into the rule by reference. Dealers that are restaurants serving food represented as halal are to post the halal disclosure statement found in Subchapter 22 as Appendix D, which is incorporated into the rule by reference. In the event there are any changes in the practices posted on the halal disclosure statement, the dealer is to immediately amend the halal disclosure statement to reflect the change in the posted practices and inform the Director in writing of the change in the stated information within 14 days. The Division will then provide the dealer with a new halal disclosure form to complete and return to the Division and a new halal disclosure statement to complete and post. A person is permitted to sell food not represented as halal as well as halal food as long as the food is properly identified and this fact is noted on the halal disclosure statement. The rule provides for an exemption to this section for a person whose sole representation of halal food is limited to the contents of food which is in properly sealed packages prepared by others who labeled the package halal. In addition to the posted disclosure statement required by this section, nursing homes, summer camps, caterers or other places which provide food pursuant to a contract shall furnish a copy of the halal disclosure statement to consumers prior to the signing of the contract.

The proposed amendment at N.J.A.C. 13:45A-22.6(d) requires a dealer to turn over all of the records (original or certified true copies) required in the rule upon the sale of the dealer's business to the purchaser.

The reproposed new rule differs from the rule proposed at 35 N.J.R. 3757(a) and not adopted in the notice of adoption published elsewhere in this issue of the Register. Proposed N.J.A.C. 1345A-22.3(a) requires a dealer selling food represented as halal to identify the type of business (that is, slaughterhouse, retail establishment, or restaurant, nursing home, summer camp, caterer or other dealer who serves prepared food pursuant to contract) they are in when they request the halal disclosure form(s) and the halal disclosure statement(s) from the Division. The Division is proposing this change in the rule as the halal disclosure statement was originally envisioned as a single statement that would be posted by any dealer. When the halal disclosure statements which are contained in this proposal were developed it was determined that a halal disclosure statement that applied to all business types was not feasible due to the length of the statement and was, therefore, broken apart into multiple statements. As a result of the multiple halal disclosure statements, the reproposed new rule amends subsection (c) to address the posting of the halal disclosure statement. Subsection (c) as proposed here requires the dealer to post the halal disclosure statement appropriate for its business type. Subsection (d) as contained in this proposal requires a dealer whose information on their posted halal disclosure statement has changed to request a new halal disclosure form and halal disclosure statement. The dealer is to return the new halal disclosure form to the Division and complete and post the new halal disclosure statement. Subsection (c) differs from the original proposal which simply required the dealer to inform the Division of the change and to amend the posted halal disclosure statement. The Division proposes this change so that the dealer's posted halal disclosure statement conforms with the halal disclosure form they have sent to the Division. The proposed amendment at N.J.A.C. 13:45A-22.6(c) requires a dealer to turn over all of the records (originals or certified true copies) required in the rule upon the sale of the dealer's business to the purchaser.

As the Division has provided a 60-day comment period on this notice of proposal, this notice is exempted from the rulemaking calendar requirement pursuant to N.J.A.C. 1:30-3.3.

Social Impact

Proposed new rule N.J.A.C. 13:45A-22.3 advances the welfare of New Jersey consumers by establishing clear standards regarding food labeled halal. The proposed new rule requires dealers who sell food represented as halal at retail to post in a location readily visible to consumers the halal disclosure statement provided by the Division. This will assist consumers when making choices about purchasing halal food as the information provided on the halal disclosure statement(s) will allow the consumer to determine whether or not the food sold as halal satisfies their understanding of halal dietary requirements. In addition, the proposed new rule will limit the likelihood of the sale of fraudulently mislabeled food because of the penalties contained in this subchapter.

The proposed amendment to N.J.A.C. 13:45A-22.6, which requires dealers to turn over their business records relating to halal purchases upon sale of the business to the purchaser, will positively impact consumers as the purchaser of the business will be able to determine if the products being sold as halal actually satisfy the posted disclosure statement.

Economic Impact

Reproposed new rule N.J.A.C. 13:45A-22.3 and the proposed Appendices will have a positive economic impact upon New Jersey consumers who purchase halal food. The proposed new rule will reduce the likelihood of consumer confusion or fraud associated with mislabeled food and the disclosure requirements ensure that consumers can make an informed decision when purchasing food labeled as halal. Dealers who sell food as halal are required by the reproposed rule to request the applicable halal disclosure form and halal disclosure statement from the Division. The dealer is required to post in a location on the premises readily visible to a customer the completed halal disclosure statement.

The minimal expense associated with the mailing that the dealer will incur is offset by the assurance that the consumer receives from the required disclosure that the food that they are purchasing satisfies their understanding of halal.

The proposed amendment to N.J.A.C. 13:45A-22.6 requires dealers who sell their business to turn over their business records (original or certified true copies) relating to halal food to the purchaser of the business.

The Division does not believe that the costs associated with copying the business records that are required to be maintained by this section by a dealer who elects to keep the original records will be significant and any costs are outweighed by the benefit received by the consumer who receives an assurance that the food they are purchasing is halal as represented.

Federal Standard Statement

A Federal standards analysis is not required because the rules and amendment are not proposed under the authority of or in order to implement, comply with or participate in any program under Federal law. The rules and amendment are proposed under the authority of New Jersey law, N.J.S.A. 56:8-98 et seq., which does not incorporate or refer to Federal law, standards or requirements.

The rules and amendment as proposed do not exceed the Federal standards set by the Federal Meat Inspection Act, 21 U.S.C. 607 et seq., the Poultry and Poultry Products Inspection Act, 21 U.S.C. 457 et seq., and the Fair Packaging and Labeling Act, 15 U.S.C. 1451 et seq. Further, as to meat and poultry, the proposed rules and amendment do not exceed the standards set by the United States Department of Agriculture in its "Food Standards and Labeling Policy Handbook" (Rev. May 2003).

Jobs Impact

The Division does not believe that the proposed rules and amendment will either increase or decrease the number of jobs in New Jersey.

Agriculture Industry Impact

The Division does not expect the new rules and amendment to have any impact on the agriculture industry in the State, as the new rules and amendment predominately address slaughterhouses and the dealers of food labeled as halal, and thus do not impact on farmers.

Regulatory Flexibility Analysis

The Regulatory Flexibility Act (Act), N.J.S.A. 52:14B-16 et seq., requires the Division to estimate the number of small businesses to which the proposal will apply. If, for purposes of the Act, dealers of halal food are "small businesses" within the meaning of the statute, the following analysis applies.

The Act requires the Division to set forth the reporting, recordkeeping and other compliance requirements of the proposal, including the kinds of professional services likely to be needed to comply with its requirements. The Act further requires the Division to estimate the initial and annual compliance costs of the proposal and set forth whether the rules establish differing compliance requirements for small businesses.

Reproposed new rule N.J.A.C. 13:45A-22.3 requires dealers who sell food as halal to request the applicable halal disclosure form and halal disclosure statement from the Division. The dealer is required to post in a location on the premises readily visible to a customer the completed halal disclosure statement. The reproposed new rule requires dealers of halal food to request a halal disclosure form and a halal disclosure statement from the Division and to complete and return the halal disclosure form to the Division within 14 calendar days of receipt.

The proposed amendment to N.J.A.C. 13:45A-22.6 requires dealers who sell their business to turn over their business records (original or certified true copies) relating to halal food to the purchaser of the business. The Division believes that the compliance costs of completing the halal disclosure form and record maintenance for dealers who sell halal food are minimal and that no professional services would be required to comply with the proposal.

In order to ensure that the protections to be afforded by the new rules and amendment will benefit all consumers, no differing compliance requirements have been established for small businesses and the rules will be applied uniformly to all dealers of halal food.

Smart Growth Impact

The new rules and amendment will have no impact on the achievement of smart growth and implementation of the State Development and Redevelopment Plan.

<<+(a) A dealer selling food represented as halal shall request in writing from the Division the halal disclosure form(s) and halal disclosure statement(s) applicable to its business. When making a request, the dealer shall identify its business type as a (or a combination of the following):+>>

<<+1. Slaughterhouse;+>>

<<+2. Retail establishment; or+>>

<<+3. Restaurant, nursing home, summer camp, caterer or other dealer who serves prepared food pursuant to a contract.+>>

<<+(b) A dealer shall complete and return to the Division within 14 calendar days of receipt the halal disclosure form(s) provided by the Division. A dealer who completes a halal disclosure form shall conform its sales practices to those it set forth on the halal disclosure form that it returns to the Division.+>>

<<+(c) A dealer selling food represented as halal shall complete and post, in a location on its premises readily visible to the consumer, the applicable halal disclosure statement provided by the Division as follows:+>>

<<+1. Slaughterhouses selling cattle, goats, sheep, and lambs represented as halal shall post the halal disclosure statement found at the end of this subchapter as Appendix A, which is incorporated into the rule by reference;+>>

<<+2. Slaughterhouses selling poultry represented as halal shall post the halal disclosure statement found at the end of this subchapter as Appendix B, which is incorporated into the rule by reference;+>>

<<+3. Retail establishments selling food represented as halal shall post the halal disclosure statement found at the end of this subchapter as Appendix C, which is incorporated into the rule by reference; and+>>

<<+4. Restaurants, nursing homes, summer camps, caterers or other dealers who serve prepared food pursuant to a contract that are serving food represented as halal shall post the halal disclosure statement found at the end of this subchapter as Appendix D, which is incorporated into the rule by reference.+>>

<<+(d) In the event of any change in the practices reported to the Division on the halal disclosure form and posted on the halal disclosure statement, a dealer shall immediately manually amend its posted halal disclosure statement to reflect the change in the posted practices and shall inform the Director in writing, and if applicable, any party to a contract, within 14 calendar days of any change in the stated information. The Division shall provide the dealer with a new halal disclosure form and a new halal disclosure statement. The dealer shall complete and return the new halal disclosure form to the Division within 14 calendar days and shall complete and post the new halal disclosure statement.+>>

<<+(e) A person may sell both food represented as halal and food not represented as halal as long as the food is properly identified and the fact is noted on the halal disclosure statement.+>>

<<+(f) A person whose sole representation of halal food is limited to the contents of food which is in properly sealed packages prepared by others who labeled the package halal shall be exempt from the requirements of this section.+>>

<<+(g) In addition to the posted halal disclosure statement required by this section, nursing homes, summer camps, caterers or other dealers who serve prepared food pursuant to a contract shall furnish to the consumer or his or her legal representative a copy of the halal disclosure statement prior to the signing of the contract.+>>
