Proposed Regulation – Telemarketing: Do Not Call Rules

NEWARK – The New Jersey Division of Consumer Affairs is proposing to readopt N.J.A.C. 13:45D, which provides procedures for the regulation of telemarketers under New Jersey's Telemarketing Do Not Call Law. All rules in N.J.A.C. 13:45D are proposed to be readopted without change, except N.J.A.C. 13:45D-4.1. The Division is proposing to amend N.J.A.C. 13:45D-4.1 to clarify that telemarketers are prohibited from making unsolicited telemarketing sales calls to customers' commercial mobile service devices, except for calls made by commercial mobile services companies to their customers under certain specified circumstances, consistent with P.L. 2015, c.2, which was signed into law in January 2015.

The proposed re-adoption with amendment, and information on how to submit a comment by November 5, 2016, can be viewed here.
