NOTICE TO BUSINESSES PROVIDING
TEMPORARY HELP SERVICES

On February 6, 2023, Governor Murphy signed into law P.L. 2023, c. 10, also known as the "Temporary Workers' Bill of Rights" ("TWBR"). Among other things, Section 8 of the TWBR prohibits temporary help service firms from making "designated classification placements," as that term is defined in the law, unless they are certified to do so "in accordance with rules" adopted by the Director of the Division of Consumer Affairs.

Businesses that make designated classification placements may begin applying for the Certification to Make Designated Classification Placements ("DCP Certification"). The DCP Certification will be required following the adoption of the rules implementing Section 8 of the TWBR; the rule proposal can be found here. Once the rules take effect, any business that seeks to make designated classification placements will need to obtain a certification to do so. Provided that you submit a completed application between July 1, 2024 and 30 days following the effective date of the adopted rules, you will be permitted to continue making designated classification placements while your application is pending. Businesses that provide designated classification placements in the interim must continue to comply with all other applicable laws and regulations, including existing registration and licensure requirements and any other applicable provisions of the TWBR.


Notice to Service Contract Providers and Administrators

Pursuant to P.L 2022, c.91, effective August 1, 2023, service contract providers and administrators in New Jersey are required to register with the Division of Consumer Affairs (“Division”). Applications for registration must be completed electronically and submitted via email to scregistration@dca.njoag.gov. Applicable registration fees must be mailed or delivered in-person to the Division’s office in Newark. Application materials and more detailed instructions can be found here.

  • Health Care Service Firms
  • Employment & Personnel Services

The Regulated Business Section registers home improvement contractors, public movers and warehousemen, and telemarketers. This unit also licenses athletic/booking agencies, career consulting or counseling services, headhunters, temporary health care agencies, nursing registries and home health care agencies, prepaid computer job-matching services, modeling and talent agencies, ticket resellers and health spas.
