Important Update Regarding Respiratory Care Licensure
in New Jersey

On November 20, 2023, New Jersey amended P.L. 1991, c.31, allowing applicants who pass the Certified Respiratory Therapy ("CRT") examination administered by the National Board of Respiratory Care ("NBRC") to apply for a plenary license as a respiratory care therapist in the State of New Jersey. This law expands New Jersey's pool of qualified respiratory care professionals by recognizing both the Registered Respiratory Therapist ("RRT") and CRT exam.

The Division of Consumer Affairs ("Division") has updated the an online application to allow for CRTs that wish to obtain a plenary license in New Jersey. Please visit www.njconsumeraffairs.gov/resp for detailed information on licensure requirements and to access the online application.

As the TERL program will end on March 31, 2024, all TERL holders will remain authorized to practice in New Jersey until that date.  Those that wish to continue the practice of respiratory care in New Jersey after March 31, 2024, must be approved by the State Board of Respiratory Care for licensure by March 31, 2024. This requires not only the submission of a completed online application, but also the provision of all other necessary documentation to the State Board of Respiratory Care (Board) as well as allowing sufficient time for processing, including the mandatory criminal history background check. Please be advised you will be provided instructions to have your fingerprints taken once you submit your application. The background check results may take several weeks once you schedule your fingerprinting appointment. Please be mindful of this timeframe. Any applicant not granted licensure by the Board by March 31, 2024, must immediately cease the practice of respiratory care in the State of New Jersey.

NOTICE

Please be advised that the application fee for Respiratory Care Practitioners who apply for a plenary license in the State of New Jersey from July 1, 2022 and through June 30, 2023, will be waived.   You still must submit your licensure fee and any other associated fees.  If you applied since July 1, 2022, and submitted your application fee, you will receive a refund of this fee only.   Please be patient while the Division processes these refunds. 

Please be advised that renewal fees for Respiratory Care Practitioners, scheduled to renew during fiscal year 2023 (from July 1, 2022 through June 30, 2023) will be waived. 


INFORMATION FOR RESPIRATORY CARE THERAPISTS SUPERSEDING ALL PRIOR NOTICES

EFFECTIVE DATE: March 22, 2023

The TERL program for respiratory care therapists will remain in place, without change, through August 31, 2023, or until the end of New Jersey's State of Emergency if that occurs prior to August 31, 2023.   

Respiratory care therapists currently holding a TERL will remain authorized to practice in New Jersey under the TERL through August 31, 2023.

The Division will continue to accept applications for TERLs from respiratory care therapists through August 31, 2023.

The Division urges respiratory care therapists who wish to continue providing respiratory care services in New Jersey after August 31, 2023 to file an application for a plenary license in New Jersey as soon as possible to avoid any gap between the expiration of the TERL and the State Board of Respiratory Care's decision regarding their application for a plenary license.

NOTICE OF DISCONTINUATION OF TEMPORARY EMERGENCY RECIPROCITY LICENSURE PROGRAMS

SUPERSEDING ALL PRIOR NOTICES
EFFECTIVE DATE: July 15, 2022

This notice is to advise that the Division of Consumer Affairs (the "Division") will be discontinuing the Temporary Emergency Reciprocity Licensure Program on August 1, 2022, for all classes of Group 2 health care practitioners, with the sole exception of respiratory care therapists.   This notice supersedes all prior notices that have been posted to the Division's website or communicated to you in prior emails.

NOTICE OF EXTENSION OF TEMPORARY EMERGENCY GRADUATE LICENSURE PROGRAMS SUPERSEDING ALL PRIOR NOTICES
EFFECTIVE DATE: July 15, 2022

Effective immediately, the Division has determined that all temporary emergency graduate licensure programs will be continued until further notice. 

Individuals currently holding TEGLs will remain authorized to practice under the TEGL, subject to the requirements set forth in AO 2020-05 and 2020-12

The Division will continue to accept applications for TEGLs from recent graduates until further notice.

COVID-19 Immunization Administration by Additional Health Care Practitioners

On February 19, 2021, the Acting Director of the Division of Consumer Affairs issued Administrative Order 2021-07 and Waiver 2021-03, which permits authorized health care personnel to administer a COVID-19 vaccine to patients upon direction from a supervising health care practitioner.  The Order and Waiver defines “authorized health care personnel” as “licensed practical nurses, certified homemaker home health aides, dentists, respiratory care therapists, perfusionists, podiatrists, optometrists, physical therapists, athletic trainers, and dental hygienists with local anesthesia permits.”  A “supervising health care practitioner” is defined as “a doctor of medicine (M.D.), a doctor of osteopathic medicine (D.O.), a registered professional nurse (R.P.N.), an advanced practice nurse (A.P.N.), a physician assistant (P.A.), or a pharmacist (R.Ph.).” The Order and Wavier requires a supervising health care practitioner to determine if authorized health care personnel are licensed in New Jersey and have been trained and are competent to administer a COVID-19 vaccine prior to directing authorized health care personnel to administer the vaccine.

The State Board of Respiratory Care was created by the provisions of the Respiratory Care Practitioner Act of 1991. This board licenses and regulates respiratory therapists in New Jersey.

Respiratory care is the health specialty involving the treatment, disease management, control, and care of patients with deficiencies and abnormalities of the cardiac and pulmonary system. Respiratory care practitioners administer oxygen and other medical gases to patients and perform treatments and tests under the supervision of doctors.
