On July 10, 2024, Governor Murphy signed into law the Real Estate Consumer Protection Enhancement Act, P.L. 2024, c.32, which, among other things, requires sellers of residential property located in New Jersey to use the "Seller's Property Condition Disclosure Statement" ("Disclosure Statement," questions 1 through 108).

Additionally, on July 3, 2023, Governor Murphy signed into law P.L. 2023, c.93, which, among other things, requires sellers of all real property located in New Jersey to make certain additional disclosures concerning flood risks on the "Disclosure Statement." On July 15, 2024, the Division published a "Flood Risk Addendum" to the Disclosure Statement (questions 109 through 117), which includes the additional disclosures concerning flood risks.

As a result of these two laws, effective August 1, 2024:

  • Sellers of residential property must complete the Disclosure Statement (questions 1 through 108).  A copy of the Disclosure Statement is available here; and
  • All sellers of real property, both residential and non-residential, must complete the Flood Risk Addendum to the Disclosure Statement (questions 109 through 117).  A copy of the Flood Risk Addendum is available here.  

The Division has created an instruction sheet with additional information regarding the use of these forms.

The forms linked above supersede any forms previously posted by the Division, including, but not limited to, the "Amended Disclosure Statement" posted on December 21, 2023.

On August 18, 2023, Governor Murphy signed P.L. 2023, c.146 (N.J.S.A. 56:8-156.1 and -156.2) into law, which, among other things, prohibits sellers from imposing a credit card surcharge that is greater than the actual cost to the seller to process the credit card payment. The Division of Consumer Affairs has issued guidance to help consumers and merchants understand their rights and obligations under the new law. The guidance is available here in English and here in Spanish.


The Office of Consumer Protection (OCP) is the primary investigative section for the New Jersey Division of Consumer Affairs, dedicated to protecting consumers from deceptive and predatory business practices in the marketplace and overseeing regulated business in the State. Among other things, OCP investigates consumer complaints against businesses and enforces New Jersey's Consumer Fraud Act and related statutes and regulations.

OCP receives consumer complaints through its central clearinghouse, the Consumer Service Center (CSC). CSC also serves as the Division's liaison with various units and regulatory boards and between the State and other consumer affairs agencies.

If you would like to check on the status of a previously filed consumer complaint, or if you would like to add additional supporting documentation to an existing complaint, please send an email to: AskConsumerAffairs@dca.njoag.gov.  Please provide the first and last name of the person who filed the complaint as well as the name of the business/entity. 

If you would like to check on the status of an investigation, please note that Division investigations are generally confidential unless and until a matter becomes public through an enforcement action. The OCP does not act as a consumer's private attorney and cannot provide legal advice. However, if you have a specific question or information pertaining to an ongoing investigation, please send an email to: AskConsumerAffairs@dca.njoag.gov, and your email will be routed to the assigned investigator.
