Proposed Regulation – Division of Consumer Affairs
NEWARK – The New Jersey Division of Consumer Affairs has proposed amendments to regulations regarding towing of motor vehicles. N.J.S.A. 56:13-13 prohibits a person from towing a motor vehicle from private property unless he or she satisfies certain conditions. P.L.2017, c.321 exempts tows authorized by law enforcement officers from the prohibitions in N.J.S.A. 56:13-13. N.J.S.A. 56:13-16 requires a towing company to release a motor vehicle to its owner or operator when the vehicle has been hooked or lifted but has not yet been removed from the property. P.L. 2017, c. 321 exempts tows authorized by law enforcement officers from these release requirements. The proposed amendments to N.J.A.C. 13:45A-31.6 and 31.8 effectuate P.L. 2017, c. 321.
