Proposed Regulation – Division of Consumer Affairs

NEWARK – The Division of Consumer Affairs has proposed new rules regarding disclosure requirements for consumer reporting agencies.

The proposed new rules effectuate P.L. 2019, c. 183. This law requires consumer reporting agencies that compile and maintain files on consumers on a nationwide basis to make certain information available upon a consumer’s request in Spanish and other languages that are the first language of a significant number of consumers in the State. The law also requires consumer reporting agencies to provide notice, in any language determined by the Director, on their websites of the availability of information subject to disclosure in languages other than English.

The proposed rules require consumer reporting agencies to make consumer reporting information available to consumers in English, Spanish, and the next six most commonly spoken languages in the state as determined by the Director of the Division of Consumer Affairs. This determination will be based on the U.S. Census Bureau’s American Community Survey, or a comparable data set, on the number of people who report speaking English at a proficiency below “very well.”

The proposal, and information on how to submit a comment by December 6, 2024, can be viewed here: https://www.njconsumeraffairs.gov/Proposals/Pages/director-10172024-proposal.aspx
