On January 8, 2024, Governor Murphy signed into law P.L. 2023, c. 237, which, among other things: amended the Contractors’ Business Registration Act (“CBRA,” formerly the “Contractors’ Registration Act”), N.J.S.A. 56:8-136 et seq., and created the “Home Improvement and Home Elevation Contractor Licensing Act,” N.J.S.A. 45:5AAA-1 et seq. On July 10, 2024, Governor Murphy signed into law the Real Estate Consumer Protection Enhancement Act, P.L. 2024, c.32, which, among other things, requires sellers of residential property located in New Jersey to use the "Seller's Property Condition Disclosure Statement" ("Disclosure Statement," questions 1 through 108).

Additionally, on July 3, 2023, Governor Murphy signed into law P.L. 2023, c.93, which, among other things, requires sellers of all real property located in New Jersey to make certain additional disclosures concerning flood risks on the "Disclosure Statement." On July 15, 2024, the Division published a "Flood Risk Addendum" to the Disclosure Statement (questions 109 through 117), which includes the additional disclosures concerning flood risks.

As a result of these two laws, effective August 1, 2024:
  • Sellers of residential property must complete the Disclosure Statement (questions 1 through 108). A copy of the Disclosure Statement is available here; and
  • All sellers of real property, both residential and non-residential, must complete the Flood Risk Addendum to the Disclosure Statement (questions 109 through 117). A copy of the Flood Risk Addendum is available here.

The Division has created an instruction sheet with additional information regarding the use of these forms. The forms linked above supersede any forms previously posted by the Division, including, but not limited to, the "Amended Disclosure Statement" posted on December 21, 2023.

Summary

N.J.A.C. 13:42-5.4 permits a psychologist who holds a Certificate of Professional Qualification (CPQ) from the Association of State and Provincial Psychology Boards (ASPPB) to obtain a license upon completion of the jurisprudence examination. This provision effectuates N.J.S.A. 45:14B-20, which permits the State Board of Psychological Examiners (Board) to issue a license without examination of credentials to an applicant who holds a diploma from a nationally recognized psychological board or agency. The Board proposes to amend this rule to clarify that it applies to a waiver of the ASPPB Examination for Professional Practice in Psychology. The amendment also permits a psychologist to obtain a license without examination if he or she is credentialed by the National Register of Health Service Psychologists.

The Board has determined that the comment period for this notice of proposal shall be 60 days; therefore, pursuant to N.J.A.C. 1:30-3.3(a)5, this notice is excepted from the rulemaking calendar requirement.
 
Social Impact

The proposed amendment will benefit psychologists who are credentialed by the National Register of Health Service Psychologists as they will qualify for licensure without examination.
 
Economic Impact

The Board believes that the proposed amendment will have a positive economic impact on psychologists who are credentialed by the National Register of Health Service Psychologists as they will not be required to pay the cost of taking the ASPPB examination in order to obtain licensure.
 
Federal Standards Statement

A Federal standards analysis is not required because the proposed amendment does not involve any Federal standards or requirements.
 
Jobs Impact

The Board does not believe that the proposed amendment will increase or decrease the number of jobs in New Jersey.
 
Agriculture Industry Impact

The Board does not believe that the proposed amendment will have any impact on the agriculture industry of this State.
 
Regulatory Flexibility Statement

The Regulatory Flexibility Act, N.J.S.A. 52:14B-16 et seq., requires the Board to give a description of the types and an estimate of the number of small businesses to which the proposed amendment will apply. A regulatory flexibility analysis is not required because the proposed amendment only applies to applicants for licensure who cannot be considered "small businesses" because they do not yet have a license to practice psychology in the State of New Jersey.
 
Housing Affordability Impact Analysis

The proposed amendment will have an insignificant impact on the affordability of housing in New Jersey and there is an extreme unlikelihood that the rule would evoke a change in the average costs associated with housing, because the proposed amendment concerns licensure application requirements for psychologists.
 
Smart Growth Development Impact Analysis

The proposed amendment will have an insignificant impact on smart growth and there is an extreme unlikelihood that the rule would evoke a change in housing production in Planning Areas 1 or 2, or within designated centers, under the State Development and Redevelopment Plan in New Jersey, because the proposed amendment concerns licensure application requirements for psychologists.

SUBCHAPTER 5.    EXAMINATION
 
13:42-5.4   License without examination
 
(a) (No change.)
 
(b) A psychologist [who holds the Association of State and Provincial Psychology Boards (ASPPB) Certificate of Professional Qualification (CPQ) in psychology and who meets all other requirements of New Jersey law,] shall be licensed following satisfactory completion of the jurisprudence examination[.] without having to take the Examination for Professional Practice in Psychology sponsored by the Association of State and Provincial Psychology Boards (ASPPB) if he or she:
 
1. Holds the ASPPB Certificate of Professional Qualification (CPQ) in psychology or is credentialed by the National Register of Health Service Psychologists; and
 
2. Meets all other requirements of New Jersey law.
