SCAM ALERT
The Division of Consumer Affairs (Division) is warning all licensed professionals about individuals impersonating New Jersey Division of Consumer Affairs (DCA) investigators, Drug Enforcement Administration (DEA) agents, DEA investigators, New Jersey Drug Control Unit investigators, Federal Bureau of Investigation (FBI) investigators, and other law enforcement personnel, as part of an extortion scheme.

The impersonators are contacting licensees by telephone or letter, stating that they are the subject of an investigation. The callers are demanding money to clear up the matter, or threatening to revoke the individual’s license. Please be advised that the Division of Consumer Affairs will not contact licensees by telephone to discuss investigations or demand money.

Anyone receiving a telephone call from a person purporting to be any of the above mentioned individuals seeking money, should refuse the demand. We encourage you to report the call to the Federal Trade Commission (FTC) at ReportFraud.ftc.gov. You may also report the call to the Division at AskConsumerAffairs@lps.state.nj.us.

HICB REGISTRATIONS

Although all current HICB registrations expire on March 31, 2025, the Division is announcing a 30-day “grace period” for the month of April 2025. During this period, the Division will not be taking action for failing to renew against any HICBs that were registered as of March 31, 2025. Additionally, no late fees will be charged to registrants who submit their renewal applications during this period. All registrants are strongly encouraged to submit their renewal applications not later than April 30, 2025, to avoid any further delays and additional application fees.


NOTICE TO BUSINESSES PROVIDING
TEMPORARY HELP SERVICES

On February 6, 2023, Governor Murphy signed into law P.L. 2023, c. 10, also known as the "Temporary Workers' Bill of Rights" ("TWBR"). Among other things, Section 8 of the TWBR prohibits temporary help service firms from making "designated classification placements," as that term is defined in the law, unless they are certified to do so "in accordance with rules" adopted by the Director of the Division of Consumer Affairs ("Division").

On September 16, 2024, the Division adopted rules implementing Section 8 of the TWBR; the rule adoption can be found here. All businesses that seek to make designated classification placements must apply for and obtain the Certification to Make Designated Classification Placements ("DCP Certification"). Provided that you submit a completed application by October 16, 2024, you will be permitted to continue making designated classification placements while your application is pending. Businesses that provide designated classification placements in the interim must continue to comply with all other applicable laws and regulations, including existing registration and licensure requirements and any other applicable provisions of the TWBR.

On October 9, 2024, the Division issued guidance for temporary help service firms regarding the bonding requirements, pursuant to P.L. 2023, c. 10, and the recently adopted regulations. The Division's guidance can be found here.


The Regulated Business Section registers/licenses: home improvement and home elevation contractor businesses, public movers and warehousemen, consulting firms (headhunters/executive search firms), temporary help service firms, health care service firms, employment agencies, entertainment/booking/modeling/talent agencies, career consulting/outplacement agencies, career counseling services, nurse registries, prepaid computer job-matching services, telemarketers, ticket resellers, health clubs, vehicle protection product warrantors, and service contract providers/administrators.
